Meeting Minutes

March 11, 2009

 

Roger Jewell, Wyatt Mills, Andrew Chagnon, Cheryl Peckham and JoAnn Teachout were in attendance.  Terry Bradley was absent.  Barbara Kinney, Conservation Administrative Assistant, was also present.

 

Mr. Mills opened the meeting at 7:00PM.

 

Citizen’s Forum

There was no one present for Citizen’s Forum.

 

Proposed Regulations promulgated under the Town of Northbridge Wetland Protection Bylaw 7-700

Mr. Mills reviewed the changes that were made with Ms. Teachout, per her suggestions, because she was not present the last time this was discussed at the January 2009 meeting.

 

Motion made by Ms. Peckham and seconded by Mr. Jewell.  The Conservation Commission voted 5-0 to accept the Northbridge Bylaw Rules and Regulations as written.

 

(01-RDA-2009) Lot 9 Hemlock Estates (Map 19, Parcel 363)

Proposed construction and grading of a twelve-foot wide driveway within the buffer zone for a single-family dwelling.  The applicant is J & F Marinella Development Corp. represented by Heritage Design Group, 1 Main Street, Whitinsville, MA  01588.

 

Cheryl Peterson of Heritage Design Group gave a summary of what is proposed.  A small portion of the entrance of the driveway is within the 100 foot buffer zone of the wetland across the street.  It is approximately 20 to 30 feet of the driveway and there will be some grading.  The contours shown on the plan are the original contours prior to stockpiling.  The Commission asked if there were any trees left on the lot and Ms. Peterson was not sure.  The Conservation Commission suggested that hay bales be placed on the downstream side of the lot.  The erosion controls from the construction of the roadway should be refreshed.

 

Motion made by Mr. Chagnon and seconded by Mr. Jewell.  The Conservation Commission voted 5-0 to issue a negative determination.

September 24, 2008

Motion made by Mr. Chagnon and seconded by Mr. Jewell.  The Conservation Commission voted 4-0-1 (Mr. Mills abstained) to approve the minutes of September 24, 2008 as written.

 

October 8, 2008

Motion made by Mr. Chagnon and seconded by Ms. Peckham.  The Conservation Commission voted 4-0-1 (Mr. Jewell abstained) to approve the minutes of October 8, 2008 as written.

 

December 10, 2008

There was no quorum to vote on these minutes.

 

January 14, 2009

Motion made by Mr. Chagnon and seconded by Mr. Jewell.  The Conservation Commission voted 4-0-1 (Ms. Teachout abstained) to approve the minutes of January 14, 2009 with the changes made by Mr. Mills.

 

Old / New Business

Standard Conditions – Review

Mr. Mills stated that he has only started to review these standard conditions and would like to continue this to a future meeting.

 

Other

Mr. Mills stated that he contacted Susan Landau at DEP regarding the enforcement order to Mr. Caya.  He informed her of the Conservation Commission’s decision to not pursue and alternative to a DEP imposed fine.  She indicated DEP would proceed with that approach.

 

The Conservation Commission scheduled a site visit for Core Mark , per the request of the engineer, on Monday, March 23, 2009 at 6:00PM.  The Conservation Commission informed the engineer that the pile of dirt on the property at 355 Main Street will be discussed at the Public Hearing because the property is owned by the same person.

 

Cheryl Peterson explained that the Order of Resource Area Delineation (ORAD) for Woodside at Northbridge (248-549) expires in June 2009 and is looking for an extension for more than one year due to the economic times.  The Conservation Commission stated that three years is fine with them.  Heritage Design Group will file the request for the extension with the Conservation Commission.

 

The Conservation Commission members present performed administrative tasks (signed Orders, etc.) that were needed.

 

Motion made by Mr. Chagnon and seconded by Mr. Jewell.  The Conservation Commission voted 5-0 to adjourn the meeting at 7:50PM.
